1. What is ON Delivery?

ON Delivery, referred to as ON Delivery, we, us, or our, is a private technology platform that provides passive digital infrastructure through which independent service providers and merchants may advertise and make their services discoverable to individuals seeking local delivery, errand, or product solutions. ON Delivery operates as a link aggregation and digital marketplace and shall not be construed as a merchant, employer, carrier, courier, or agent for any party.

ON Delivery does not own, store, handle, package, or deliver any physical goods. ON Delivery provides no warranties, insurances, guarantees, or agency services and exercises no control over the actions, omissions, or performance of users, merchants, or delivery providers.

ON Delivery operates in a functionally analogous manner to services such as Craigslist.org or Facebook Marketplace, providing only a technological means of listing and linking, and not any involvement in the transaction, execution, or verification thereof.

2. Use terms for ON Delivery

a. Capacity and Consent

By accessing the ON Delivery platform, you certify under penalty of perjury and in accordance with Black's Law Dictionary, 12th ed., definitions of legal capacity that you are a natural person and not a legal fiction, corporate strawman, or artificial entity. You are 18 years of age or older, or the legal age of majority in your jurisdiction. You possess legal capacity to contract, defined as the ability to understand rights and obligations and to make a legally binding agreement. You consent to these Terms and Conditions freely, voluntarily, and without coercion or reliance upon verbal representations outside this document.

b. Binding Agreement

These Terms shall constitute a binding, enforceable agreement between ON Delivery and you, the User, under the laws of the State of Michigan and applicable federal statutes.

c. Limited License of Use

ON Delivery grants you a revocable, non-transferable, non-exclusive limited license to access and use the platform for lawful, personal, and non-commercial purposes in accordance with these Terms. This license does not confer any proprietary interest or agency relationship.

d. Platform Scope

You acknowledge that ON Delivery does not verify the identity, licensure, or compliance status of any merchant or delivery agent. ON Delivery does not inspect, regulate, or certify any product, service, or act occurring off-platform. ON Delivery is not obligated to intervene in disputes, refunds, delays, or errors. ON Delivery makes no representation that any merchant or service provider is safe, legal, or reliable.

2-3. CASH-ON-DELIVERY POLICY

If a merchant or delivery agent offers you the option to pay using cash-on-delivery, you understand and agree that ON Delivery is not a party to such exchange. ON Delivery exercises no control over the acceptance, accuracy, or return of COD payments. All disputes arising from COD transactions must be resolved directly between you and the provider. ON Delivery shall be held harmless and indemnified against all liability, disputes, or claims arising from or related to such transactions.

You agree to use COD at your own sole risk, and to exercise prudent caution in all such exchanges, especially involving physical meetups or large sums.

2-4. PRIVACY POLICY

ON Delivery collects only the minimum personal data required to operate the platform, such as full name, contact information, approximate location, and communication records. Browser session data and app behavior are also collected for fraud prevention and system integrity.

ON Delivery shall never sell your personal data to any third party or use your information for any purpose other than linking services or improving user experience. We may share data with independent contractors or merchants only to facilitate a transaction initiated by the user.

2-5. COOKIES AND TRACKING

Our platform uses digital cookies, local storage, and tracking technologies in accordance with legal standards and for the following purposes: functionality enhancements, usage analytics, security monitoring, and user experience optimization.

You may disable cookies in your browser, although some features may not function correctly.

2-6. USER POLICY

By using this platform, you agree to not engage in unlawful conduct or fraudulent transactions via the platform. You will not impersonate others, falsify information, or defame third parties. You will not transmit harmful code, viruses, or unsolicited advertising. You understand that misuse of the platform may result in immediate account termination and legal action.

ON Delivery reserves the right to remove, suspend, or ban access to any user at any time for any violation of these Terms.

2-7. USER RESPONSIBILITIES

You acknowledge and agree that ON Delivery is not liable for the performance, accuracy, safety, quality, or delivery of any service or product promoted or offered through the platform. You assume all risks and responsibilities for transactions, deliveries, and in-person exchanges arising from your use of the platform. You are solely responsible for complying with all applicable laws, ordinances, and safety regulations in your jurisdiction. You release and indemnify ON Delivery, its officers, directors, agents, and representatives from all claims, lawsuits, injuries, losses, or damages of any kind arising from or related to your use of the platform.

This includes, but is not limited to, personal injury, property damage, misrepresentation, delivery failure, theft, assault, or third-party misconduct.

2-8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, ON Delivery shall not be liable for any incidental, indirect, punitive, or consequential damages arising out of or in connection with platform usage. ON Delivery disclaims any and all liability for physical, financial, or emotional injury caused by third-party interactions or service failures. ON Delivery shall not be liable for errors in listing, missed deliveries, incomplete transactions, or lost items.

Your sole and exclusive remedy is to discontinue use of the platform.

2-9. AMENDMENTS

ON Delivery reserves the right to amend these Terms at any time. Updated Terms will be posted with a revised Effective Date. Continued use constitutes acceptance of such changes.

2-10. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by the laws of the State of Michigan and applicable federal law. You consent to submit all disputes to binding arbitration administered in Wayne County, Michigan. You waive your right to a jury trial or to participate in class action litigation.

This agreement shall be construed in accordance with Black's Law Dictionary, 12th ed., and the plain meaning of its terms.
